Green and leafy! Could be a spec ops guy in disguise though, so be careful when and if you decide to chop it down.

Kind of looks like a ficus to me - "weeping benjamin" (cool name huh?). Depends if it gets really cold where you live, I don't think they like the cold. Pretty tree.

What color is the bark? Can't see well in that pic. If it is redish, it could be a choke cherry. Does it flower?
