So do you think she's a crackpot? or do you say good for her, stick it to best buy?

I personally think she is a crackpot, she said:
you want to waste all that time and money for that?? I think she needs to grow up and take the $4,100.00.

Dont get me wrong Best Buy was absolutely in the wrong for losing it and not telling her for 3 months and for that they should be penalized for but to take someone to court just to explain how they lost it? ridiculous.

Thats just my opinion :D what do you think?

$54M is ridiculous but I'd hold out for more than $4,100 now with the way she has been treated and the loss of the personal information,I'd be miles more annoyed about the way they handled the situation than the actual loss, its like rubbing salt in the wound.

I think $4,100 is more than fair. Is best buy responsible for her not backing up her own information?

I think that best buy handled it completely wrong, they should have been up front about the loss of her laptop and compensated her appropriately but who in their right mind would leave personally identifiable information on there? When your car goes through the wash, you take anything of value out of the car so it doesnt get stolen right?

Irrelevant IMO,she didn't lose the information if she had it would have been her fault she didn't have backups.

Nearly every single person who sends their computer in for repair whether they know it or not,if you are smart enough to clean all your personal info off your computer and everything that someone my be able to use to embarrass you,you could probably fix it yourself, they are bound by confidentiality and if thats broken I think there should be substantial compensation.

I say she deserves every single dime that she can sue out of BestBuy.

There is a myriad of reasons and each one is good enough that she should win.

Obviously BestBuy is wrong and should pay her but they should always promote a backup solution and save themselves of this type of legal harassment. You don't want a backup, OK then don't blame us when it happens. Marketing would really hate that part!:D

The fact we are discussing this issue kinda proves her point, and accomplished her goal toward Best Buy besides. Think anyone would care if she had asked for $4.1K?

I do think she should end up with a better computer than they lost, for the hassle factor, but not much more. The point of backups is valid, but why should anyone blank their computer before repairing it? The data is much more valuable than the machine in the long run, it is why you have the machine in the first place. Might even defeat the point of having it repaired in the first place, if it is a conflict between drivers or software packages.

    OOPS!!!!!

    Mistake # 1 - Go way overboard.

Mistake # 2 - Fight corporate lawyers with no representation.

$54 million, WTF, the case should be dismissed, the courts are already filled with Bullsh#t, this person is just trying to scam!

She should take the $4100 and consider herself Lucky!

If BB would have just admitted they lost the notebook from the get go, they legally would have only be liable for the original cost of the notebook.
When she demanded $2100, which was too much, I'll bet she was being an AIS

As for the Data, if your dumb enough not to Back it up, I say Too F_ing Bad :booger

Thing is, its not a data loss issue, its a data theft issue.

Identitiy theft can easily cost more than 4100 dollars to deal with.

I say let Best Buy eat the cost. Every bit of it, including the incurring cost of constantly monitoring your credit, attorneys, and whatever else it cost.

Good for her, hope she wins. Then maybe Bestbuy will take better precautions when handling their customers property and information.

Of course I am biased, as Best Buy destroyed one of my machines out of sheer neglect. They fixed it, then shipped it back.

UPS ground. With no packing. Lose in a box.

Needless to say, the computer did NOT arrive in one piece. Whats worse is, Best Buy lied about it for over four months. Then, they made me stand at their stupid service counter for over an hour while they "pretended" to find my computer.
