Well it must be very upsetting for the owners and yes i would sue. Not quite sure about the amount though.

Doesn't seem quite right though... 206k over "emotional distress" and "loss of breeding opportunities?" How many labs sell for that much?

Also, they did leave him in the state's custody longer than they had to. They couldn't afford the $106 to get him out and had to wait til payday, which makes the claim of 206k even more suspicious...

As for the emotional distress... who would they sue when it comes time for the dog to die a natural death?

And if you're going to go as far as mentioning loss of breeding opportunity, when does the vet sue for revenue they lost over all the shots, and visits that they won't get from every puppy that may or may not have been born?

I think a lawsuit is alright in this case, but not to make money.. maybe to have the $106 waived, and possibly the depreciated value of the dog paid to them.

It doesn't say how long the shelter had been holding the animal...only that it was to be picked up on the 16th...that's something I would like to know.

here's the article from the Denton County Newspaper http://www.dentonrc.com/sharedcontent/dws/drc/localnews/stories/DRC_dog_0602.510c3437.html

I think the city was sadly within its rights. They say they're available for adoption or euthanasia after 4 days.. The family may have been told after the 15th it would be a crap shoot...

Ahhh, well then. There's no reason it couldn't have been a simple mistake. The pickup date would have been a sidenote, and probably not somewhere the worker would normally look.

Had been 7 days at that point, I think the family got lucky there. This isn't a $200K mistake. $200 maybe. The dog was a mutt! Breeding opportunities by mutt!

Maybe justified if the shelter had broke protocol (which they did in the family's favour), or showed evidence of extreme incompetence, but I'm not seeing either.

Come now. We all know how valuable mutts are. I mean, who wouldn't pay a hefty price for a non-purebred puppy?

    Noobs.
