An open letter to the ACLU

    Dear Sir or Madam,

    I am a disabled person, who works only part time, and can hardly afford to be suspended for a week without pay for "creating a disturbance at the work site." But I know that I carry little weight in the grand scheme of things.

    The disiplinary action came about because I mentioned to a young couple that was parked in a space with the handicapped logo that they could be fined up to $250 if they did not have a handicapped plate or hanger. That was all I told them. I went back to my office and was later told by my supervisor that the supervisor at the Dept. Of Workforce Services ( the unemployment office ) had told her that I "was to stop harassing their clients and that it was perfectly alright for people to park in the handicapped space if they were just dropping off papers and such."

    I work under what was called "Experience Works" which is funded by the Dept. of Labor. My job is to do computer maintanence at the W.A.G.E center where they help people gain better skills to be able to find a better job. We have a tacit relationship with the DWS in that we help their clients get these better skills and attain job readiness certifications. But the W.A.G.E. center is under the Adult Education Dept. which is under the umbrella of the local school system.

    I called the police to discuss the situation with them and a policeman came and talked to me and basically said that all I can do is call them if there is someone illegally parking in those spaces. ( Something that happens frequently though out the day, I might add).

    Apparently the presents of the officer spurred the DWS supervisor to contact my boss at Experience Works who then had no choice but to suspend me. She usually gives people a two week suspension but either she was convinced by my supervisor that they needed me too much or she was sympathetic to the situation. I don't know. However, what I do know is that if I ever cause another "disruption at the work site" I will be fired.

    This means that should I ever call the police to report someone illegally parked, this would be grounds to fire me as the DWS supervisor would complain again at the presents of the police .

    I do not know what to do, but it seems as though my civil liberties have been trampled.

    ps: an update. During the week of my suspension, it was decided that since the Wage center has had a tenious relationship in the past with the DWS, it would be best to not have me back. So I am now out of a job.

    Well damn....that all seems pretty pathetic. Personally I get VERY upset at those who use handicapped spots simply b/c they are to darn lazy to walk a few more steps...It's no wonder we have an obesity epidemic.

    What about contacting your local office for the Federal Labor Board? Or the Disabilities ( I forget the actual agency name) which is also on a Federal level? If they terminated your employment simply over a handicapped parking space they are violating all kinds of laws.

    Personally, I wouldn't take it sitting down. Even a call )or letter) to your local Congressman or State Legislator might be a huge step in the right direction.

    You must write to the the editorial/opinion section of your local newspapers. Contact the editors and try to get face time so you can discuss an op-ed piece. Newspapers that are reluctant to allow opinion pieces that trash local businesses will usually jump at the chance to expose governmental agencies and their abuse of power. Public opinion can embarrass the 'bosses' of the officious 'little hitlers' and that's when you'll likely get favorable action.

    If it's a slow news day, sometimes these little stories get national exposure. That's when you'll be truly avenged. :)

    Jeez Tim, that's horrible.:( Sorry about the job. You should definitely file a complaint with the right agency (the ACLU is the right start). There has to be at least a few justified complaints that you would definitely have a case with.

    Oh man, I'd go postal but that won't help much either. What is wrong with these people? I am hopping MAD!!!:boxing Nobody seems to care much about handicapped spots here either, until they get a hefty ticket! Good luck Tim.

    I appreciate the thoughts, all. :)

    Once I can buy some ink for the printer the letter is going out to the ACLU. And I have emailed the US Equal Employment commission, the state Attorney General, a tv station and the local paper.

    I am, as you can imagine, are very disturbed by this. It is hard enough to see all those losing their jobs to the economy, but it stinks to lose it due to a bureaucrat who misuses her power.

    So sorry to hear about your unfair treatment. As a disabled person you would already have more clout in the legal system (sort of a "protected class"). It also sounds like you were denied due process for simply speaking to someone in the parking lot. Talk about Little Hitlers. I would approach a TV station before the newspaper. There's something about a reporter and camera crew showing up to talk to your so-called supervisors that can be very intimidating. And since it's a public building they can't very well deny entrance to the media. It also gets the attention of their bosses. Once the higher-ups are made aware of what really transpired you may very well get your job back with apologies. One can hope. Best of luck. ;)

    Not here it isn't, if you're not handicapped you can't park there even for a minute. This is just wrong on so many levels and The Dept. of Labor should know better!

    I believe in karma. The able bodied people that park in handicapped parking spots are asking to become handicapped in my opinion.

    couldn't type fast enough to get it all in. it is not okay for people to park in a handicap spot if they are just dropping off something or picking something up. it is illegal period, unless the person is handicapped and has a placard or his vehicles plates are handicap plates and that person is handicapped. drives me crazy. go here: http://www.handicappedfraud.org/index.php?mod=about

    I am so sorry to hear of this miscarriage of your rights Tim, as a disabled person myself i understand just how you feel when able bodied people park in the bays reserved for disabled, It is a personal grievance of mine as my wife is also disabled and we have 2 cards.
    At our local supermarket they have 3 bays for disabled and invariably they are full but if you sit and wait for the occupants of the vehicles to return 7 times out of 10 they are able bodied and unfortunately the police here do not consider it a priority.

    I hope you get all the help you deserve in righting this flagrant breach of human rights.

    Truely a case of when is a handicapped zone not a handicapped zone! never heard such crap before in my life, those zones are for a purpose, just like stopping at a red light is.


    Is this not and not knowing US law well enough but in UK would be classes as discrimination in the workplace, your bosses are discriminating against you and your handicap which is criminal and even the police have mentioned to contatc them if someone is illegally parked, if it was legal then they wouldnt have mentioned for you to call them, I would be seeking legal advice and contacting local senator/congressman or better still the Secretary for Labor in Hildar L Solis (iirc is acting or now in post) http://solis.house.gov/contact/email.shtml

    I sincerely appreciate everyone's support on this issue and have followed up with even more emails to gov. officials.

    Unfortunately, the agency that places me in jobs ( "Experience Works" which is for old farts that can't find a job for whatever reason) does not have any other "computer lab" type partners, so they may not be able to find any other job for me since I can not do physical labor.

    My warning to all of you ----> be good so you die young. :-D

    Just an idea, is there a local college newspaper in the area, they usually have an interest in human rights and if you get it in a local other papers pick it up. We have Northwestern here and like oldandconfusedagain thought, public pressure usually makes them rethink a issue.

    The lesson is that you did the right thing while they did the wrong thing.

    Your disability counts for something. Don't be afraid to use it in your favor. Some TV video footage of you in your wheelchair outside the building where the goons fired you could be very helpful. Don't be reluctant to play the "victim" role here, because that's what you are: the victim of gutless, vindictive managers. Did they have something against you from earlier incidents? Were they looking for a reason to get rid of you? It would be nice if there was an employee-rights type lawyer who would take the case on a contingent fee (you pay nothing unless they win). Back pay, an apology, and a punitive settlement. Isn't there a department in your state government that stands up for workers' rights, especially handicapped workers' rights?

    Thank frapper......I am thankfully not yet in a wheelchair as the cane is all I need so far to go short distances.

    I did email the EEOC....:)

    And this neo-nazi has never met me nor have I ever done anything to cross her.

    That's good. That means you won't feel guilty when you get her fired for abuse of power, discrimination, and for being a total... well, I can't say it here or you might ban me, but it's a vulgar and deeply insulting word and it begins with a "c" ;)

    Above all, I'm glad to see you're not taking this laying down. Not that I expected you to, but all the same, it's nice to see someone stand up for their rights and fight back once in a while. Keep it up. :boxing

    As for your printer ink for the ACLU letter, this might be an option? Oh, and here is the disability discrimination section of their website, if you are interested.

    Fight it Bro! Just a suggestion, a walker makes you look innocent as hell. Can you use one for a photo shoot?

    Just joking a bit. You are right. The handicap spot is not for deliveries, it is for the people that need it! I count myself lucky to not need that spot. Some messed up stuff is going on, get a lawyer.

    I cannot believe you WORK FOR the Department of Labor and this happened! WTF???? They're usually who I tell people to contact in cases like this.

    http://www.eeoc.gov/contact.html would be your best bet for starters, but the DOL has several sections on their website with way more information than I have time to read, starting here: http://www.dol.gov/odep/index.htm

    I would also contact your state DOL. All of them should be email-able to get the ball rolling, and the ball needs to roll ASAP.

    You're not, by any remote chance, represented by a union, are you? They're good for stuff like this. ;)

    Apparently I only read the first couple of posts before I went off, and I see you have already emailed the EEOC. :-D This just makes me so mad I could kick puppies.

    So sorry TimW just saw this, I sincerely hope you get some sort of satisfaction. Is there even an ACLU anymore? You would think not the way people are abused these days.
    Perhaps with new administrations there's hope.
    Here in Armpit :) there a tv station with an investigating team. If nothing else the pure embarrassment of a situation at times will turn things around. Seems like you have to point out to people that things are not right, pity. Stupidity Rules

    Tim, bureaucracy takes it's time. I'd send an exact copy of your email by registered mail to them for backup. With proof of their signature of receipt they can't claim not having received your email and may come in handy at a later time.

    Can imagine you're sitting on hot coals now, waiting for an answer. I feel for you.

    I've been fighting with a dentist for such a ridiculous long time, have a bundle of registered mail receipts. Thinking I was ready for court I thought I better get an expert to look things over. Turned out the receipts mean nothing if signed by someone else (as mine are signed by the office manager).

    You did the right thing, sometimes it seems like no good deed goes unpunished. Heck of a time to lose a job, seems like that is happening all to frequently to many of us lately. Turn up the pressure, and start networking, this is a good place to start. You are probably better suited for employment elsewhere, and now at least you know what kind of dirtbags you were working for. Sorry about your loss, mom says time heals all wounds, and that when one door closes another one opens.

    if it means returning to the area,get a friend to take 'em.

    This is really bugging me Tim! Can you get a written reason for termination? Can you get video or pictures of cars illegally parked in the handicapped spot? Especially with the license plates viewable.

    If you can show that delivery company A parks in a handicapped spot on a regular basis, that would be good. Get lots of video/pictures, try to get the written reason for termination in a casual way, so you don't raise any suspicions. Think like an investigative reporter. You will need proof, and details. Heck, lie and tell them you are trying to milk the unemployment stuff, you are happy you got fired!

    If you have any friends still employed there, see if you can get any written company policies on parking. Delivery people have no special rights on where they can park.

    Once you get some evidence, find a good lawyer. And sue the Bas:***'s!

    Be carefull, dot your i's and cross your t's because you are going to be fighting the government.

    I realize that laws vary from country to country but surely there is some sort of protection available for workers.
    In Belgium you can only be dismissed instantly for 3 thing fighting (you and i both are out of that category) sexual harassment or theft and they come under the heading gross misconduct all other reasons for dismissal you are entitled to a written confirmation.
    I can't help but feel you have fallen victim to a policy of reducing the number of employees in these times of financial hardship and you were an easy target.

    This site can give invaluable help and it is available in various countries as i do not know your country of residence (guess USA)

    I wasn't technically fired. I was just asked to not come back to the site where "Experience Works" had placed me. This is a program funded by the DOL ( Dept.of Labor) to help older workers gain experience ( in my case I was the one giving experience to the people at the WAGE Center). So one of the rules with this program is you are not allowed to "create a disturbance at the work site." The state employee complained and that was all that was needed to justify my suspension. The gutless wonders at the WAGE Center did not want to jeopardize their relationship with this b*tch.

    Arkansas is a "Work for Hire" state, meaning that you can be dismissed from a job for any or no reason. I was technically not employed by the Wage Center -- they just had the benefit of my knowledge to keep their computer lab running.

    The unfortunate side is that the EW program does not have any where else for me to do this kind of work.

    At this point, no one has responded to any of my emails ( other than one attorney stating that in his opinion, no laws were broken). It's the pits in that my disability limits me to about 20 hrs per week in a good week. So there is little opportunity to find a "real" job.

    Let me again say that I truly appreciate everyones comments and support. But this looks like it is turning out to be a case of "bend over and grab your ankles, this will only hurt for a little while."

    Temp work or as needed is the pits, my stepson did that long ago and your not really considered an employee with anyone.
    Another aspect in large companies hiring part time under a certain amount of hours with no obligation to offer benefits. How it is in Ca anyway, I realize states differ in their labor laws.
    Have a labor board there Tim?
