Need Some Advice

    Need help deciding what to do. Next Tuesday, my husband has hip replacement surgery. He will be in the hospital for a couple of days, then can come home with assistance, I talked to my supervisor about a FML (Family Medical Leave). She told me I could, but only when he is OUT of hospital, not while he has surgery and is in there.
    Well, yesterday I took the paperwork into the doctor's office, and his Medical Secretary couldn't believe what my supervisor has said. She told me she fills these out every day and has never heard of it not starting till a patient goes home. She also asked where I worked. She said she was going to talk to the doctor, because I do need to be there while the hubby is in the hospital to learn how to help him get out of bed, put on his TED socks, etc.
    Now, my question is.........Do I ask my supervisor about it again? And be on the "sh--" list forever? Or do I just wait and see what dates the doctor puts on the FML paperwork?
    And, if I ask my supervisor, how do I do it diplomatically?

    Sorry to hear that your Hubby requires "Hip Surgery" gal1998, as I have had a few friends whom have had this surgery, all I can say is that everyone of them has come out of Surgery a happier person, and none had any problems after. Recovery can be a bit of a painful experience, but all say it is much better than the pain they felt before. My best wishes to you both.

    Re: Your Supervisor, I would recommend that you ask your Doctor or his Nurse to write down what she has told you and give it to your Supervisor, with a copy to her boss if she does not follow through. So on the letter make certain you place a CC: to her as well as her boss, this lets her know that you will follow through, and avoid an argument.     Thank you BC. He has hip dysplasia, commonly found in dogs. Arthritis has moved in now, and with degeneration, he now has bone on bone, so it is time. His hip is that of an 80 year old man, and the other, of a 60 year old. He is only 43, but has taken my 2 years to finally get him into a specialist.
    From what the doctor tells us, he will wake up after surgery in less pain than he has now.

    Do you have a personnel manager? I would go to that person ...not your supervisor who may or may not know the law.

    From what management at work tells me, if the company meets the requirements of the FMLA, then it is the doctor that determines when leave time starts and stops, not the company.

    Sorry to here about your husband needing surgery. My father had similar and was much better after the surgery. I hope all goes well.

    Yes, I do , but unfortunately, she is out on Maternity leave. Any questions we have are to be directed to the Supervisor, so I am right back where I started.
    I do plan on using some vacation so might just let it go and use that for when he is in the hosptital. Then, I guess, it won't matter when the leave starts.

    Just an update on the FML. The Medical Secretary called me at work today and told me the doctor has it filled out and he put the date of surgery and release date on the FML and said if my supervisor has a problem with it, they are to call him directly. SO...........guess it is out of my hands....lol
