    Here in the USA there is a vast number of frivolous law suits that back up the courts. In my opinion there should be an arbitration board these lawsuits should go through before they can clog up the courts. Most should not nor would they ever make it to court.
    If they actually make it to court the amount of money set for damages needs to held in check. The case you slighted over a pair of pants is a good example.

    I agree.
    The arbritration boards can be headed by law professors and retired judges.

    We need Tort reform in the US . . . I believe we are one of the few, if not the only one, whose legal system allows such shenanigans.

    The problem with getting Tort reform? In my opinion it's because most of the dead-weight politicos in Congress are Lawyers. They don't want Tort reform, since it could have a direct effect on their livelihood. Not all legal eagles feel this way . . . but enough do to keep any real reform from getting anywhere fast.

    Where I live in Cook County, the court system went to on-line filing only. No more paper filing. Great!-> not!! As a land-loard for 25 years, with two rental houses. I used to go down to court to file a eviction notice or damages to a unit. Very seldom as I think fairly good on issues. Going down there to file I would get help with the ppl there to get it done. Not now.

    Pcs have merely doubled my workload as I now save paper and files on PC.

    I hope that they don't come out with another invention that superceeds the pc otherwise my work load will probably be trebled......

    Cheesy Lawsuit against McDonald's for 5 Million Dollars Over Unwanted Cheese
    Two South Floridians don’t want cheese on their Quarter Pounders, and they think they should pay less for their
    Quarter Pounder orders when they visit McDonald’s restaurants. Their lawyers claim the customers have “suffered injury” for having to pay the full price for a Quarter Pounder with Cheese and that McDonald’s is “unjustly enriched”
    when people who don’t want cheese pay full price for a burger.

    The most outrageous lawsuit that I ever heard off happened about 10 years ago.

    Mrs. Merv Grazinski, of Oklahoma City, purchased a new 32-foot Winnebago motor home.

    On her first trip home, from an OU football game, having driven on to the freeway, she set the cruise control at 70 mph and calmly left the driver's seat to go to the back of the Winnebago to make herself a sandwich.

    Not surprisingly, the motor home left the freeway, crashed and overturned. Also not surprisingly, Mrs. Grazinski sued Winnebago for not putting in the owner's manual that she couldn't actually leave the driver's seat while the cruise control was set.

    The Oklahoma jury awarded her – are you sitting down? – $1,750,000 plus a new motor home. Winnebago actually changed their manuals as a result of this suit

    Makes you wonder.........

    Still off topic - Yeah - with today's technology we can have special effects.
    I'm continually "housekeeping, sorting and filing" on my computer to maintain order, more so than I ever used to with hardcopies...reckon people don't always think twice before shooting off something...In the old "Quilled pen and Paper" days, being so expensive and effort to deliver had everything at a slower pace.

    On topic - some people need attention and some thrive on it - regardless if the attention directed at them is bad or good.

    I refer to these people as suers - pronounced the same as sewers... :D

    As far as McDonalds goes. Kinda nit picky, but I see how they are going to try to win. If you ask for something extra. Say extra-more tartar sauce on your fish sandwitch. They charge you for it. Leave something off, they don't discount. Along with other fast food places doing the same.

    They win, look out Burger King, Taco Bell, you name a place.

    Only thing this will do is menu's being changed to up-charge on any thing added from a plain order. Want salt with them fry's. 2 cents extra per pac, ketchup is 3 cents a pac.

    Want some special sauce with the Big Mac? 10 cents more. Want Lettuce?

    Legislative changes/reform is never an easy task and with tort* law coming from common law, tort judgments often rely on prededents or a new precedent depending on the matter in issue.

    So with tort law reform, it becomes a difficult task given the different types of torts (wrongs) falling under common law and if needing to take into consideration any other law/regulation/policy.

    Not sure how American law goes, but here, changes to a proposed law goes through our Parliament with the amendments introduced to either our House of Representatives or the Senate and must be agreed by both chambers.

    So I can only presume America would have the same/similar process for changes.

    Put simply - it's a lot of time/work/processes for approval before amendments can occur so changes can't happen overnight <sigh> which is generally frustrating for those wanting changes.






    * tort: duty, breach of duty; causation and injury; a wrongful act or an infringement of a right (other than under contract) leading to legal liability. Public nuisance is a crime as well as tort.
