Actually that soundcard is known for having problems with many recent games, though that is hard to figure out. Do you have the latest drivers for it installed?
You could also try to diminish the hardware acceleration for the soundcard a notch or more.
To do this go to the start menu, "run", write "dxdiag" and execute it. On the "sound tab", check for a slider called "hardware sound acceleration" or something like that, drag it one notch to the left and exit. If the game still behaves like that try the other positions to the left. This solution works wonders with many games, so you could try it.

If you've have read my last post i did say i was losing my sound effects but still would have the music playing and i was running a sound blaster live sound card ut i've not played in a while and i have a new computer and a cmedia 8738 sound card, It has to be a eax sound issue.

ok just to clear up the EAX issue here: i was having a similar problem except i had no music and only some effects. i had to turn off any EAX effects (from the Creative EAX Console) kinda like equalizer presets, for it to work properly. if you have EAX you should be able to access the EAX console from the Creative folder in the start menu
