I think her sentence needed to be longer, 5 months is too short of a time.
She definitly needs to give back to the peoples, donate hella $$ for a huge park or community service for years.

it would be interesting to see M.S. cleaning the sides of highways..

Martha Stewart.... the woman everybody loves to hate... since long before this cropped up.

Considering all the shenanigans that go in the stock market with little or no consequences, her penalty was way out of line. Let's make an example of her! Hangin's too good for her! Off with her head!

I wonder how this would have played if it had been Hillary Clinton.

Oh, wait a minute... Rose Law Firm... Whitewater... Hillary's already had her chance and came out scott free.

    Justice? Uh-uh.

Also not a fan (housework makes you ugly) but considering crimes others have committed it is ridiculous.

Welcome to America. Where to masses of lazy, incompetent idiots stroll around and visicously attack someone because they themselves are lazy and jelous of that person and never imagine that sort of success themselves and this is heard by a judge who is as stupid as these people and reacts appropriately. I dont own a single Martha Stewart item and frankly find her annoying. If she died tommorow, I would hardly notice. But, its still wrong. Must be extra room in the federal prisons. Got nothing else to say.

If "equal justice under the law" was a reality, OJ would have gotten the death penalty, and Stewart would have gotten a fine and a slap on the wrist.

If justice is not the same for everybody, there is no justice, and YOU personally are at risk of being unfairly treated at some point, either by being unpopular yourself, or by being abused by somebody that IS popular, or has political clout, or has friends in high places, and you have no way to demand "justice" for your case.

Ask not for whom the bell tolls... it tolls for thee.

The biggest irony is that the stock is now selling for about 50% more than Stewart sold hers for, so if whoever got it, held on to it, they made out like a bandit.

The Martha Stewart Show is shown all over the world. She is a national icon. America's reputation is not the best right now on the world scene. I think part of it is to show that American justice spares nobody, not even our icons. Even though the sentence is light IMHO, as least she did not get away scot free. Had that been one of us common people we would have paid with a certain body part...

Look, I am not saying she did nothing, what I am saying is this shows how out of whack our system is. I could kill any one of you and be free in 7 years. But if I take some insider trading advice.... maybe... I get 5 months, plus 5 months house arrest and years of probation. Dont even DARE to reply and tell me thats reasonable. Call me when murderers go to jail for life, as deserved. Period. Eye for an eye I believe, maybe that my problem. I dont buy this crap that each judge decides who gets what based on his mood that day, or God forbid a jury of our moron peers. Ever met anyone who did jury duty? Yeah, thats because most of us who are busy dont have the time, so your so caled peers are anything but. She gained 51,000? Well, heres a scenario. Collect 51,000. Oh, thats right, it would go back to our court system never to be seen or accounted for.

    SPARE ME!

We forget that everything was all good till she got caught.

She wants to portray the all American I care about you and therefore you should feel sorry for me person

    Yeah right

A lot of people feel sorry for her because she is the type of person that can make you go collect weeds from your yard and then give you instructions on how to boil them and by the amount of each weed you can enhance your mood and be happy. She is Americas homemaker and she is a sweety

the truth is she got caught and like all rich people that get caught she thinks she should not have to pay for her bull. She thinks she is above the law

besides she is going to serve time not because she made the money or because she had some insider trading. she is going to jail bacause she lied to a federal agent and tried to cover the shit up so that her lie would not be discovered.

The only reason why I think is bull is because the law is so out of whack. The word justice in our Country is a joke. There is no consistency and therefore no justice

    I agree completely.
One of my company Lawyers told me years ago (after I had been ripped off for $750,000  ), when I asked him "Whatever happened to justice?" He just laughed and said, (when he eventually stopped smirking), "What has justice got to do with it? What we are talking about here is process of law and the luck of the draw."

Never did get a cent back - just another K$50 worth of legal bills! Sure, the guy eventually went to jail over ripping off some other companies in Europe, but it did less than squat for me.

It is my firm belief that there is a price tag on "justice". If you can afford to pay for everything that your lawyer may fancy you have a better chance for a technicality. I offer O.J. as the example. If you are Joe Blow your chances are somewhere between slim and none. The examples of crime committed and disproportionate sentencing, or aquittal, are staggering. Locally we had an instance of a drunk driver who struck an elderly woman and maimed her for life. He spent a total of 10 days in jail. The judge let him out with the standard sentencing for driving under the influence and time served. The judge and this man are neighbors, have known each other for years. The judge refused to recuse himself as he said that he did not believe that this would interfere with his judgement. Obviously, IMHO, it did. Happens all of the time in the USA. My Dad used to say that anything can be bought, that everything has its price. Our stilted justice system doles out fines, jail terms and conditions that are well,...just wrong...and they do it all of the time. The piece that fries me is that often I think that they know something's going on, yet turn a blind eye until somebody raises a fuss. It's just sad.

I'm not a Martha fan by any streach of the imagination, but I would think the embarasment of the whole situation is making her blood boil. Also the additional attorney fees must be in the millions. She lost alot of credibility again today saying she did nothing wrong and this 'personal' matter was blown way out of porportion. She honestly believes she did nothing wrong. A perfect example of someone who just doesn't get it.

Last few posts, agreed, agreed, agreed. Until Endi who said:

Your second paragraph is correct and contradictes the rest of your comments. She should have to pay it back, and then some. But who gets that money? Thats right, the biggest crooks of all who have no accountability. These so called "rich people" who get away with it accomplish nothing with jail time, so I will reverse it on you. How about this. Your right! Poor poeple: Jail time. Rich people: Hit em where it hurts, make em pay 10 times the damage to charities. Of course, you would probably think that sets them scott free too, right? Sure. Poor people who have nothing to lose, have nothing to contribute and are frankly more of a threat because of that. Hit these so called rich people where it hurts. Jail time? Too funny! 5 months in a federal prison? Too funny.

Thats ok, shes them there rich people, she's got it, no sweat. Its more important she goes to jail for sure. I am glad you had a talk with her and she told you she knows she did nothing wrong, thanks for the heads up and insight. ;) <--- Thats a wink. That means sarcasm.

In many cases, it's people who have alot of money that hate spending it more than those with less money. It must really make her mad to know she spent several millions of her dollars in a lawsuit.

That was my point :) That 51,000 cost her millions. Have here donate some money, without tax breaks, to some worthwhile charities (though I am sure she already does) or something. But, 5 months in jail is 5 months she does not earn as well and people forget that people with money like that often donate to charities (sure sometimes for a tax break, but so what) and communities in large numbers and something like this could cause a person like this to become very bitter and drop all those donations, even at if it costs tax deductions. She wont forget.

Now that I read my post again. you are right it does slightly contradict.:D

I guess they are forgiven by our justice system because they produce more money for the system. You would not cut your best players from the team same thing here.

It all boils down to this. Greedy ass people who cannot seem to be happy with all the millions they have already made. they thirst for more even though they already have it all (materialistic)

It would be great if all the money they have was made legally. But not only was she a milliornaire already she wanted more. You are right, in the end she paid a whole lot more than the money she made. but the point has been made she thought she was not going to get caught therefore she did it. she fell good to feel the power of insider info and salivated like a dog about to eat a bone. I bet it felt good at the time.

Then she went on tv and tried to tell me how to live my life and boil some home grown weeds:D:D LOL

Can't do the time do not do the crime.

Does any body know if she gets the bottom or top bunk:D:D:D

I know that MA said, way back up, that those who shoot people only get seven years, might be that way in New York, here in California we have the three strikes rule?s. When you shoot somebody in my area, they tend to find a few other strikes, from within your case, so that you end up with three?..and a 40 to life and/or no possibility of parole?..wobbles

and what's her good Behavior for time off, going to be....used to be 2/3 in her case just a even 100 days

  43. G.T.

    G.T. R.I.P February 4, 2007. You will be missed.

She didn't screw anybody out of anything. Her stock broker got advanced warning of news that would impact the stock value, which he shouldn't have had (that's called insider information), and advised Stewart to sell her stock before the news broke, before it's value dropped (that's called insider trading). She told him to sell, he put it back on the market, and somebody else that was looking to buy that stock bought it. Happens all the time, is seldom noticed, and seldom prosecuted. And punishment is generally just a dollar fine, not jail time. For a stock broker, they may lose their license.

She, and her stock broker, then lied, tried to cover up & protect themselves in the investigation that followed, which, again, it common practice.

Were both of those actions wrong? Yes. Do both of those actions potentially carry the penalties that were handed out? Yes.

BUT... and it's a very big but.... this level of punishment for this level of crime is almost never handed out. Stewart was picked to "be an example", largely because she's well known, a lot of people don't like her and are jealous of her success. If it was standard practice to punish this crime in this way, I'd have no beef with it. She should have known the risks for what she was doing. As it is, she and her broker didn't think they were risking much of anything, and they were given "special" justice just for them.

"Special" justice is all too common in this country, usually working in favor of those at the top, and those at the bottom rightly resent that. But justice is supposed to be impartial. Excesses at either end of the bar are wrong.

Much of the celebration over Stewart's humiliation is simple class envy and class warfare that's fed and encouraged by many Democrats and most minority figureheads, and is no more noble or right than the celebration of the beheadings of ALL nobility, men women and children, during the French Revolution, regardless of how good or bad a person they actually were.

UN equal treatment under the law is always damaging to our system, in whichever direction the inequality goes. We don't create a just society by balancing the injustice on one side of the fence by celebrating injustice on the other side. We do it by demanding consistent treatment of everybody, and by condemning ALL the excesses.

But Doctor Guillotine was wildly entertaining and popular in 18th century France. He's still popular today.

And, again for show, I read that Boby Fisher, the chess champion is going to be extradited from Japan (after some kind of dust up with the Japanese police) and the Feds want him because he played a championship in Yugoslavia years ago when it was a banned country -- indeed when Yugoslavia still existed which it does not now. Who next? Mr. Rodgers? Oh that's right, Fred comitted suicide rather than let the Feds have him. Well then, guess they're after the really BIG fish now. Julia Child run fer it!
