Need to break into a OS X MacBook, legally !!!

    ok, i bought a macbook running os x (not sure exactly which version) off of ebay for $200, the catch was, it belonged to someone who went through a divorce, the husband gave her the laptop but no info for it, so she sold it online. I bought leopard 10.5 but I need to login to the laptop before it will let me do a re-install. How do I recover the username and password? I know some of you think its stolen,NO IT'S NOT !!!! I really need to format the drive and re-install.
