Rant: Moving again but to Florida now.

    We been in this house since November 2008, It is a big older house built in the 40's. It is Four Huge bedroom and Two Bath. Huge Front room, Huge kitchen, Huge Den and Huge Living room(All Hardwood Floors) . And Huge Washer/ Dryer room plus a huge closet for storage. Plus a porch and a two car carport in the back of house. And two Three Ton a/c Units. And a brick sidewalk that leads to a patio. It is completely Landscaped and has privacy fence around the backyard. And a gate that leads to the carports. For 550.00 a month. Asking price 68,000.00.

    Sounds like a dream right?

    Well Wrong.........

    The Roof Leaks, The Toilet Runs, There is a broken sewage pipe outside by the bathroom window, The walls are cracking , Storm windows where put in backwards, And the tub in the Master bedroom is falling through the floor. And it is up to code!

    The man we were getting this House from said that the house was in Great condition. (Lair!)
    When we moved in we signed a piece of paper stating that we were renting to own.
    We paid on the First every month 550.00.(Check)
    We woke up this morning by J.K( the Man) beating on the door.
    J.K was serving us a Eviction notice! (HUH!) Giving us less than 30 days to get our **** and get out!
    Our Eviction notice was on a receipt paper. Saying he had found somebody to buy the house.(What!)

    I want to know what the hell we were doing?!

    There was a family that came by yesterday to look at the house and they were talking about renting this house just in cause we moved.
    Well They went ahead and paid for next month!(WTF)

    Everyone that knows me knows I am not racists.
    But once again Uncle Sam and old WHITE men( That voted for Obama) give African American's the upper hand on us white folk!!!

    I'm really not mad due to the fact that this house was nothing but a heart-ache and that it is falling apart!! So we will gladly pack our shit and move!
    But best believe we will be taking everything Including Our fu**ing Gate J.K made us pay for!!
    So thank you for the washer/dryer, Fridge, Dinning table and chairs, And OUR GATE!!!!!

    Oh yea, before I forget J.K You Old Fu**er!!
    You get satisfaction and joy off of people's hard times.... But listen and listen good, We paid you every month and the ones before us didn't . So makes you think that you are not getting another one of them?
    But I am not crying!
    And Oh Yea I know you are getting investigated on fraud . Setting houses on fire! And we know you have messed with this one too!
    So Good luck to you A$$HOLE.

    WOW! I'm sorry to here you gettin the wrong end of the deal,but If the laws there are anything like Florida then he did what is called an " Written contract" with you to buy the house and has
    1. just broken that contract. You have A law suit right there. "Breach of contract."
    2.If you were paying by the month then he has to give you a 3 day notice, to which you do not have to respond to.
    3.Then he serves you with a notice that you will have to vacate the premises and he has to give this notice 15 days prior to the next rent due date.
    4. He would have to go to the court house and file an eviction notice which he will have to pay for ($80. in Fl)That right there gives you 30 days to reply to his eviction notice.
    But seeing how you've been up to date on your payment he has no just or legal cause to evict you. Again assuming the laws are the same. I know this only because I was renting out rooms in my sons house while he was over the road and the house was empty. I had a few bad apples who thought they didn't have to pay every month. You don't have to move right out if you've paid for this month.
    If I were you I would go to the court house in your area and see if they have a law library and present your situation to the librarian there, or see if there is a free legal service(our's called "Legal Aid") but all in all if the city/county that you live in came out and inspected the house and said it was up to code with all you said was wrong, had to of gotten paid off or the landlord BS'ed you . Take pic's of the damages of the roof, bathtub and the broken sewage pipe.

    btw I hope you kept all your receipts and any other papers that you or the landlord may have signed. Those are a BIG plus in court.

    Yep we keep track of everything. Btw i lived in Fla for 26years before moving here to this county back in 2000 now think we are moving back to Polk County near Polk City well keep you updated..

    Um... not trying to be rude here, but I seriously doubt it has anything to do with race or color. This guy is more likely to screw you over because he thinks he can get more money out of the ones that he wants to have in the house than he was getting from you, than because of anything else. Of course, that doesn't mean it sucks any less to suddenly be evicted.

    I'm with bigtrucks on this, if you have copies of all receipts and papers, you can challenge this and it should be very hard for the land lord to show proof that he has done everything by the books. Granted I'm not in Florida, but in my state, you need to go by the county court house to get papers on everything that involves kicking out a paying tenant, starting with showing proof that they deserve being kicked out. From what it sounds like, if you want to fight this, you have a case.

    On the other hand, if you would rather move on to something better, then the less to drag you down the better. Eat the crow, concede the fight, and move on. Just don't give that douchebag bastard any more money ;)

    As far as money goes, that is probably the better long-term choice. Judging from your posts, the sooner you get out of there and away from him, the better. Let someone else pay this guy for a sub-standard house and get yourself a nice, reliable, comfortable home.

    Well you'll be about 1 1/2 hrs south of me. And I agree with Mimsy you are better off leaving that head ache for somebody else. He'll get his just rewards in do time.

    Yeah this is a bit raw and i dont mean the wrestling, have had a simialr experience where the real estate agent that was handling the property had the house on the market, tells us that some investment buyer took the house on as a rental and asked if we were happy to stay there...well of course no move no extra expense moving and setting up new digs etc...on the Monday the day the conveyancing went through the new owner turns up at about 11am see's people still living there and exits the property without a word about half an hour later get a panicked call from the real estate agent saying well how quick can we get out....same thing w.t.f over in my neck of the woods you get 42 days or seven weeks in this sort of scenario tho before they can evict you...

    Figure the real estate agents that were also handling the rental decided to get thier cut of the rental commission right upto the last second..B*stards! the Saturday before "are you guys still happy to stay there...frigging....expletive rant...blimming...ahol.....more rant...what made it worse my flat mate had just gone back to work that day and had just finished six weeks off..we could of used that time to find another house, instead he moves back into some sort of boarding house about four days later...good grief!

    Unfortunately the government over here is too onto it they know because they are so useless with the legal side of things that they dont allow us to sue...heck I'd be up there with bill gates with all the professional misconduct I've experienced, everything from being almost killed by a doctor for administrating a adult dosage of some drug that left me in intensive care for 8 days through to unjustified dismissals, unjustified insults from boss's that have other staff coming up and saying are you O.K?

    Going back to the property i was renting had one of the relestate agents turn up unannounced which they arent supposed to do I was just out of the shower talking to my m8 on the phone and the only one home just wrapped in a towel...well this female real estate agent happens to turn up with a potential buyer also a female, both tore around the house at light speed, there was only one hitch..when they first came in I told them not to go into my bedroom because I was going to be getting changed in the next few minutes. It must've gone in one ear and out the other because certainly no longer than five minutes later, when I had only just gone into my bedroom, they both come flying in the room blowing the door practically of its hinges as they entered, here I am in the all together so to speak...I was not amused...and had few choice words none of which one would class as tame as they fled the property trying not to grin...

    But thats my rant...back to yours..sue the B, you say youve got everything on paper, well thats a contract..he cant evict you unless he can prove that you have breached your agreement, on the other hand you can go him for distress and a whole raft of other things that we just dont get over here someone from the local real estate association / consortium or equivalent should be able to point you in the right direction. I firmly believe you have a leg to stand on given what you've written. It might help pay off this house a bit sooner, if not and you still let him get rid of the house that is if your not keen on it, then with your new monies from the aforementioned scoundrel.. rent to own guy.. put that on a nicer house..

    I'm sure at the very least if your monies as rent to own has been paid and this could be proven eg on paper that you would at least get this monies back as it was rent to own this means x amount of $ in that house is yours...how are you to recoupe this loss if he's evicting you...? he's not giving a fair option i'm sure a judge will see this too... do our homework get everything in writing, ask people for there names, (also ask for letters of reciept acknowledging that they have recieved your letter querry or if by email a read reciept is potentially just as binding), that you come into contact with throughout this process, as they will be more aware and potentially more accurate if there are any comebacks and potentially more likely to also remember you. Which can be a good thing , ask for thier name at the end of the conversation though, so that they're not on guard from the outset.

    Hey wish you the best in this, I really hate this kind of thing gives me the S**** when this sort of thing goes on hence this overly long rant...but get justice...its what all our forefathers died fighting for, no justice then thy father has been dishonoured...and I wouldnt sit down and take it even if the place was junk... thats not the point.

    Sorry to hear you are in the wars NJ.
    I am of the same opinion as other posters that you must have some recourse to action if only to recover your moving costs plus a certain amount for distress.
    I openly admit i have no idea about the laws on this in the US but i cannot believe there is no protection against an unscrupulous landlord.
    Let us know how you get on and i really hope you can screw the SOB.

    Sounds to me the huge house would be a huge expense to bring up to where it should be. He might be doing you a favor in the long run selling it to someone else, although nothing sounds legal to me.
    Moving is a royal pain so good luck with that.

    Honestly, given the info on the house, id be happy to leave if i were you. Unless you were planning on putting in A LOT of money to fix it up....
    Sounds like it would be a great house to fix up though if you had the money and time.

    Hi NJ, I hope you can recover some of your money, that guy is as Mimsy said, a "douchebag", so maybe in the long run, these 'new' people will get one over on him ! It is tough, when you do everything right, and still end up on the short end of the stick... That really sucks... I hope you get a better place, and a much nicer place than this money pit you were in.... Good luck,;)
