have you tried a different driver for your 9600xt?

    Hi:
I have an ATI Radeon 9800XT (Cat 5.3/DirectX9.0c) and follow this routine when changing ATI's driver/ctrl panel software:
    1. Start >Control Panel >Add or Remove Programs >ATI Control Panel >Remove.
    2. Do not Restart when prompted.
    3. ATI Display Driver >Remove.
    4. Restart when prompted.
    5. Upon return to Desktop in Windows Standard display drivers, cancel offer to install drivers.
    6. Start >Run >browse to where you downloaded the new ATI Catalyst driver package and run it.

If the above doesn’t work out, download this util: ATI Catalyst uninstaller http://www.ati.com/support/drivers/misc/catalystutils.html
This will clean your system of any ATI software along with any remnants that could be causing problems.
Use it instead of steps 1, 2 and 3 above; then continue with steps 4, 5 and 6.

I don't know if the above applies to a Sapphire cards but I know that following this has avoided all glitchs with this card and the ATI Radeon 9700 Pro I used perviously.

    Happy trails

Unfortunatly I have tried the uninstall and reinstall.
I have also tried the clean install approach.

The drivers i have used are
    current release drivers from ati
    Neo drivers

It seems to be some sort of memory problem, getting from main memory to gpu memory, problem is that i can not pin point the issue. the jitter seems to be random, .25 second in duration and I have tried a few other D3D apps and they have the same problems (directx 9.0c).

unfortunatly the soulution you suggest would have been solved with the third party drivers i installed as smartgart was not included in these versions.

    Thanks Tho :)

I think i am going to put in my mx440 an see what happens.
I am also thinking of ditching the 9600xt on ebay and getting a 6600gt

I remember having problems with my 9800Pro and graphics glitches on GTA:VC and had to turn on VSync and manually change it in the ini file from 60Hz to something like 100Hz. I don't remember it running choppy, but there were tons of glitches... You might try hunting around in your ini file for something like that. When I have more time, I'll search around some more.
