Can someone on SSI in Georgia be sued in Small Claims Court?

    Its a Ex-landlord trying to sue us for $8400 and thats for damages and owed rent when we did not owe no rent and there was no damages that trailer is only worth $8400 well anyways we had to break the lease for health issues. So now he thinks he can get a Payday i guess. Is there something in this State like what they have in California Firned?

    If you owed no rent and caused no damage then there is no case.
    Simple as that pretty much anywhere in the world.
    If you gave ample warning for breaching the lease and it's on medical grounds backed up by a doctor then again, there is no case.

    You may want to clarify, NJ just a bit more. How long was the lease? What state ? Georgia or CA??? Also, what is this??? "California Firned?" I don't think that is even a word..:confused

    Anyone can be sued in small claims court, it just depends on the evidence your landlord has.. If you have nothing to hide, then you have nothing to worry about.. I do believe, every state has small claims courts... Also, if you signed a lease, YOU are responsible for all rent for the duration of that lease, UNLESS you gave written notice at least 30 days in advance that you would be leaving, but then again, it would depend on what state you are in, what your lease specifically says, and whether or not you can even leave before the lease is up, and what the consequences would be if you broke it.. You have to look at the big picture here.

    Since none of us are lawyers practicing in your state, I would strongly suggest you talk this over with a lawyer. $8400 is way above most state small claims amounts. If you do not respond and he gets a default adjudication, then you are forever stuck with this on your credit records. :major

    Georgia's Small Claims Court ('Magistrate Court') limit is $15,000
    Get legal advice quickly. There are plenty of free access legal advice centers/phone lines for people on SSI/Low Income.
    And as TimW says you should definitely not let a default decision be made.
    Whether or not a financial claim and finding against you could be enforced, just because you are on SSI, is not the question.
    If someone is found guilty of a breach of contract or something that results in a fine or whatever, they are guilty no matter whether they can pay the fine or not, and it will follow them around until (and even after) they do manage to pay it.

    In California, if there is no way to collect monetarily, you could loose your drivers license.

    I know a loser guy that moved here from Cali lost his driver license for no child support down there paid.

    Yes, that too, the DMV has way too much control here.
