I'm having a hard day

    It would seem that you and your significant other are too good for your own good. If such had happened to me in my hometown and state, they and all their possessions would have been outside beside the highway, law or not!! I take a very dim view of people taking advantage of others ! You are to be praised for your patience in this. :)

    so Sunday morning the police were called again (by them) because i shouted at them and 'disturbed their peace'. after that i started to take stock a bit and made a few phone calls. they have done this LOADS of times! the reason they are ringing the police is so that it is THEIR name on all the complaints. they really know their way round the system. i went to the police today to file charges for credit card theft and was advised to take out a 'TRO' against them in family court as they are living with me. i was also told that i need the local police to investigate the credit card fraud. so went to the local police (the ones that have already been round twice and think I'm unwilling to compromise, and slightly hysterical) and tried to explain that they need to take this situation seriously. that i have been systematically stolen from and scammed. that i do not allow people to walk all over me and then roll over so they can kick my butt to boot. that i want them to pursue the theft charge and enforce the TRO. so they said they would (they were actually remarkably supportive :) ) now i have to wait another day. more tomorrow. aloha (PS.no i cant get a court order unless i have a written, signed for, 45 day notice, and until that time date. PPS there is some thing wrong with my editing. each time i change a letter it deletes the one next to it. have i pressed something by accident?

    Is there anything in the credit card paper trail that ties this to them specifically?

    If you can nail the exact date/time as well as the station, that station may have videotape of them actually pumping it, although if too much time has passed, they may have recycled the tape already.

    Check out whatever you can yourself. Don't expect the cops to be overly creative and motivated on their own. The ones I've had ocassion to need were massively underwhelming.

    ditto. it is possible that i will get nowhere with that either, but i CAN trace time and date for at least two amounts. as to whether the gas station will still have those records is another matter. however the fact that they have threatened me (we're gonna find a way to 'do you over') is apparently enough to have them removed under domestic court guidelines. strange isn't it, that as a former battered wife, who at the time could receive NO help because it was a "domestic" matter (england 1975ish) , am now relying on the same system to resolve this. (US took domestic violence far more seriously, far more quickly) anyway night night all, more tomorrow. aloha

    Hope tomorrow brings better news for you. if you file against them in domestic court how long is THAT going to take?
    or can you just get a restraining order, in which case they'll have to vacate immediately...wouldn't that be nice.

    Only just came across this thread. Hope all goes well with you. I live in a block of 8 flats so have to put up with deadbeat neighbours. At least you can/will get rid of them eventually. Some people are really a blight on paradise. Bazza

    Actually, in 1975 domestic issues weren't taken as seriously here either. They've gotten a lot more hair-trigger in recent years.

    yes, thats because women kept being killed! anyway went to family court today, didnt have to testify, the TRO is issued first, for 90 days. i have to justify it on the 20th june. that shouldnt be a problem!. the're not in at the moment, so i now have to wait untill they come in to ring the police and have them served. it looks like tonight will be the first nights sleep i have gotten in a week. fingers crossed people. much aloha.

    the police escorted them from the property at 2:00pm hawaiian time. they are not allowed to come within 100yds of me or my home. they are not allowed to call or contact me. :) :)

    I'm really glad for you, I hope by law that when they're looking for a new place that they have to let possible new landlords know their last place of residence so when they call to ask you'll let them know how rotten they were to you!

    Do keep an eye on things for a while. They may be stupid enough to try carrying out their vague threat. And DO prepare for your day before the court. Get everything together and documented that you possibly can.

    thank you all so much for your comfort and support, and for letting me document this odd series of events. im not really one for writing things down, but i have found this all so confusing and distressing that it has helped to put it 'on paper' so to speak. it was a way of stepping back from it all. very much aloha to you all.

    That is superb new Laurie, I bet you feel a huge weight has been lifted off your shoulders :)

    Yeah as GT said keep everything documented.... and if they communicate with you have either a witness or write down everything with times and dates also do a bet of background reading on the law.

    Whenever there's a chance you'll need to get the law or courts involved, it's MANDATORY that you write things down, with dates, times, and all the details you can provide. Normally, this is accepted as evidence, not to mention it helps you keep track of all the dirty details. Without that, you've got nothing but vague recollections, which are NOT evidence of any kind.

    You're not done yet. You've got to go to court on the 20th and SHOW the court why that restraining order was necessary. Get it all down on paper and organized as best you can NOW. The longer you wait, the less you'll remember.

    thanks GT. i am in the process of gathering reports and photographing the damage done to the room and furniture. the TRO will probably stand on its own ground, but i have more to add to it just in case it doesn't. the relief at not having them here is tremendous. i think its given my poor hubby an ulcer. like me, he doesn't deal well with being powerless. he still wants to hurt these people, and subsequently feels guilty. every time he tried to plot revenge, we argued because i don't need any more trouble than i already have. every time he talked reason, we argued because i felt unsupported or misunderstood. no win situ. fortunately we know these things about each other, and can normally deflect our irritations with laughter. aloha
