returning software; whos right?

    Whenever I install a new piece of purchased software, the EULA almost always says if i dont agree with it, return it to the place of purchase for a full refund.
    OF course, you need to open the package to see this.
    And most retailers wont take back opened software; which confuses me, since the manufacturer says I can.....its not like the store has anything to lose.

    So, what Im wondering is, if I were to buy software, disagree with the EULA, do I have any way to return the product for a refund?

    (You can live in a car, but you cant drive a house!)

    Don't have the answer but, you can drive a house, ie: Motor Home............ :D

    Try returning it directly to the manufacturer, or if you want the store to return it, follow these directions:
    1. try returning it opened for FULL refund
    2. (if 1 didn't work) print out a copy of the EULA
    3. show it to them, and tell them they are required to let you return it.
    4. If they refuse, ask for manager. The manager usually actually cares about what you think about their store, unlike the employees. (most of the time)

    A distribitutor is not legally required to accept it back.

    Its not their EULA, and not their product.

    They are simply distributing it.

    Now the program vendor that has a EULA as such is legally required to keep their end of the deal and take it back.

    Who's right? You are aren't you? You are the customer and the customer is always right. The store knows it (well the managers do anyway). The Software vendors know it.

    Everybody has a boss, all you have to reach one that makes you happy.

    Legally, I think your biggest hurdle if you live in the USA is the UCITA, (Uniform Computer Information Transactions Act). Google it for news.

    If nobody makes you happy, try the United States Government, more specifically, the Federal Trade Commission. Remember I said everybody has a boss; well guess who ultimately is the boss is of the US Government.
