transfer of non-owned registrar locked domain?

    a domain name i've been looking to grab for awhile now has been set on registrar-lock and was just a placeholder domain. but now its still a placeholder domain, but it does not have any nameservers associated with it, and it is no longer on registrar-lock. can i legally just transfer the domain with a domain transfer service ie. godaddy.com ? or must i wait for it to expire + the 45 day grace period?
